  1. Introduction

Your privacy is important to us. Tres Griegos, LLC (collectively, “Company” “us,” “our,” and “we”) understands your concerns regarding how information about you may be used and shared, and we appreciate that you trust us to use and share information about you carefully and sensibly.

This Privacy Policy describes what personal information we may collect about you, how we may collect it, how we may use it, with whom we may share it, and what choices you may have regarding it.

This Privacy Policy applies to your use of the Site (as defined in the Terms of Use). This Privacy Policy does not apply to any websites or facilities operated by third parties. We are not responsible for, and this Privacy Policy does not apply to, the privacy practices of other companies or other websites. We encourage you to seek out and read the privacy policy of each website that you visit.

  1. How We May Collect Your Personal Information?

Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. We do not collect any Personal Information about you unless you voluntarily provide it to us. However, you may be required to provide certain Personal Information to us when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

When you use our Site, we and our third-party service providers may automatically collect information about how you access and use the Sites and information about the device you use to access the Sites. We typically collect this information through a variety of tools, including Google Analytics, to enable data recording and indexing, and similar technology (collectively, “tracking technologies”). We and our third-party partners may automatically collect information such as:

  • Page analytics (for all pages, who visits, how long, and average engagement time per session)
  • Active users by country, city, and language
  • Traffic acquisition to determine whether you visited our Site due to an organic search, directly, through a referral, organic social media use, or otherwise

  • Average session duration
  • Active users by operating system, platform or device, browser, screen resolution, and device category (mobile, desktop, tablet)

We may process Personal Information to provide services to you and additional services you request, as well as to respond to communications from you. The precise purposes for which your Personal Information may be processed will be determined by the request and by applicable laws, regulatory guidance, and professional standards.

We may use information we collect from you and information that we may collect automatically to manage and improve our Sites and our business. We take steps to ensure that your rights are safeguarded. For example, we may use information to:

  • Third-party service providers. We may disclose your Personal Information to our vendors and other third-party service providers, such as credit card processors and website hosts, that help us provide services, support features on our Site or in the restaurants, or otherwise market our products and services.
  • Legal requirements and business transfers. We may disclose Personal Information: (a) if we are required to do so by law, legal process, statute, rule, regulation, or professional standard, or to respond to a subpoena, search warrant, or other government official requests; (b) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss; (c) in connection with an investigation of a complaint, security threat, or suspected or actual illegal activity; (d) in connection with an internal audit; or (e) in the event that Company is subject to mergers, acquisitions, joint ventures, sales of assets, reorganizations, divestitures, dissolutions, bankruptcies, liquidations, or other types of business transactions. In these types of transactions, Personal Information may be shared, sold, or transferred, and it may be used subsequently by a third party.

We offer certain choices about how we communicate with you and what Personal Information we may obtain about you and share with others.

  • E-mail. If you no longer wish to receive promotional or informational emails from us, you may opt out from receiving future emails from us by following the instructions for unsubscribing in the promotional or informational emails we send you or by contacting us at the email address or phone number below.
  • Cookies. We provide a variety of services on our Site using cookies. We place cookies on your device to provide you with personalized access to essential services, enhance functionality, and show you offers and services tailored to your interests. A cookie is a small piece of data that a website can send to your browser, which may then be stored on your hard drive as a “tag” that identifies your computer.   1. De-Identified/Aggregate Information

We may collect, use, share, transfer, and otherwise process de-identified and aggregated information that it receives or creates for any purpose at its sole discretion, in compliance with applicable laws. We are the sole and exclusive owner of such de-identified and aggregated information, including if we de-identify Personal Information so that it is no longer considered Personal Information under applicable laws.

  1. Data Automatically Collected

The Company may automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, access times, and referring website addresses. This information is used for the operation of our business, to maintain quality of the products and services we offer, and to provide general statistics regarding the use of the Site.

  1. Retaining Your Personal Information

We will retain your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless otherwise required by applicable laws. Criteria we will use to determine how long we will retain your Personal Information include whether we need your Personal Information to provide you with our Site or other services; you have requested information from us; we have a legal right or obligation to continue to retain your Personal Information; we have an obligation to a third party that involves your Personal Information; our retention or recordkeeping policies and obligations dictate that we retain your Personal Information; or we have another business purpose for retaining your Personal Information.

  1. Third-Party Links

Occasionally, at our discretion, we may include or offer third-party products or services on our Site. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. We urge you to read the privacy policies of other websites before submitting any information to those websites. Please be aware that to submit job application materials online to work with us, you will be redirected from our Site to a website operated by our third-party service provider. You may be required to create an account with that vendor. We encourage you to review the terms and privacy policy posted on that vendor’s website since this Privacy Policy does not govern your use of that website.

  1. Security of Your Personal Information

The Company secures your Personal Information from unauthorized access, use, or disclosure using SSL Protocol. When Personal Information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

We strive to take commercially reasonable security measures to protect against unauthorized access to or alteration of your Personal Information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information using commercially reasonable efforts, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the Site cannot be guaranteed.

  1. California Residents’ Privacy Rights

This Section regarding the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”), supplements this Privacy Policy solely with respect to all visitors, users, and others who reside in the State of California (each, a “Consumer”).  Any terms defined in the CCPA, as amended, have the same meaning when used in this Section. The Company uses your Personal Information for the purposes described in this Privacy Policy, which include “business purposes” under the CCPA. CCPA provides Covered Persons with specific rights regarding Personal Information. This Section describes such rights and explains how to exercise those rights.

You have the following rights with respect to your Personal Information:

  • The right to know about the Personal Information that we collect about you and to know how it is used and shared;
  • The right to delete Personal Information collected from you consistent with applicable law;
  • The right to opt-out of the sale or sharing of your Personal Information;
  • The right to non-discrimination in exercising your rights;
  • The right to correct inaccurate Personal Information that we have about you; and
  • The right to limit the use and disclosure of sensitive Personal Information collected about you.

Access to Specific Information. In the past 12 months, the Company has collected your Internet or similar network activity and geolocation data, in each case, in order to maintain, protect, and improve the Site, its Content (as defined in the Terms of Use), and the Company’s products and services.

Data Portability Rights.  Consumers have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable Consumer request (see “Exercising Data Portability and Deletion Rights”), we will disclose to you: (a) the categories of Personal Information we collected about you, (b) our business or commercial purpose for collecting that Personal Information, (c) the categories of third parties with whom we share your Personal Information (in the event you have opted in to our sharing of such Personal Information with such third parties), (d) the specific pieces of Personal Information we collected about you (also called a data portability request), and (e) if we sold or disclosed your Personal Information for a business purpose, lists disclosing the following: (i) sales, identifying the Personal Information categories that each category of recipient purchased; and (ii) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights.  You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable Consumer request (see “Exercising Data Portability and Deletion Rights”), we will delete (and direct our service providers to delete) your Personal Information from our records, unless a statutory exception applies to the data.  We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to (a) complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you, (b) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities, (c) comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.), (d) enable solely internal uses that are reasonably aligned with Consumer expectations based on your relationship with us, (e) comply with a legal obligation, or (f) make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Data Portability and Deletion Rights.  To exercise the access, data portability, and deletion rights described above, please submit a verifiable Consumer request by emailing us at info@ilovejacks.com. Only you, or someone legally authorized to act on your behalf, may make a verifiable Consumer request related to your Personal Information. A Parent may also make a verifiable Consumer request on behalf of your Child. To designate an authorized agent, please submit a document with your authorized agent’s full name, contact information, a statement granting the agent access to your Personal Information or request deletion of your Personal Information, and your signatures to info@ilovejacks.com. You may only make a verifiable request for access or data portability twice within a 12-month period. The verifiable request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, which may include: (a) submitting evidence of your identity that matches 2 data points already in our possession; and (b) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you.  We will only use Personal Information provided in a verifiable Consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format. We endeavor to respond to a verifiable Consumer request within 45 days of its receipt. If we require more time, up to 45 additional days, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the receipt of a verifiable Consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically as either a downloadable .pdf or .csv file. We do not charge a fee to process or respond to your verifiable Consumer request unless the request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales. We do not sell, rent, or lease your Personal Information to third parties.

Nondiscrimination. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: (a) deny you services; (b) charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties, (c) provide you a different level or quality of services, or (d) suggest that you may receive a different price or rate for services or a different level or quality of services.

  1. Children’s Information

 Our Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on the Site or on or through any of its features, including your name, address, telephone number, email address, or any username you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at info@ilovejacks.com.

  1. Changes to Our Privacy Policy

We may change this Privacy Policy from time to time, and we will post any changes on this page. Each version of this Privacy Policy is identified at the top of the page by its Effective Date. If we make material changes to how we treat our users’ Personal Information, we may notify you by email and/or through a notice on our Site’s home page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting our Site and this Privacy Policy to check for any changes.
